Here are some of the fundamental aspects of a commercial property lease in Queensland that owners and tenants should consider: The purpose of the Federal Government`s Code of Conduct is to impose a number of principles of good faith for commercial leasing (including retail, office and industry) between owners/operators/other landlords and tenants whose tenant is a legitimate business for the purposes of the Federal Government`s JobKeeper program. These principles apply to the negotiation of amendments to existing leasing agreements in good faith – to support proportionate cash flow management for SME tenants and landlords – as a result of the effects and business disruptions caused by the economic impact of industry and government responses to the declared CORONAVIRUS COVID 19 pandemic. Repairs and maintenance are the responsibility of the tenant, but all structural work is the responsibility of the owner. This issue can be controversial if there is disagreement about the nature of the shortage. If landlords and tenants fail to reach an agreement on rental agreements (as a direct result of the COVID-19 pandemic), the case should be referred and submitted (by both parties) to the national or territorial procedures in force for the settlement of retail and commercial rental disputes for mandatory mediation, including, where appropriate, small business commissioners/champions/mediators.
